How big an addition can I build in Whitby before I need a minor variance?

Where Whitby's By-law 1784 zones a lot R1, R2 or R3, as of October 2026, a house may cover 20% of its lot and must keep a 6.0 m rear yard, which Ontario's 90% setback rule now reads as 5.4 m. Beyond those limits the Town's Committee of Adjustment decides, for a $1,526 residential fee, and the addition's building permit is $22.37 per m².

Building in Whitby

How much of my Whitby lot can the house cover?

In the R1 to R3 zones of By-law 1784, a by-law dating from 1960, the answer is 20%. Here is what Schedule A asks of an interior lot, with the deemed 90% figures beside it:

ZoneSmallest serviced lot20% of that lotRear yard (90%)Interior side yard (90%)
R11,020 m²204 m²6.0 m (5.4 m)1.5 m (1.35 m)
R2925 m²185 m²6.0 m (5.4 m)1.5 m (1.35 m)
R3835 m²167 m²6.0 m (5.4 m)1.5 m (1.35 m)

Note: coverage figures are our arithmetic on the minimum lot; your lot is probably bigger, and Schedule A warns that not every amendment is folded into it. A house with no garage needs 5.0 m on one side.

Much of Whitby isn't zoned R1 to R3. Many newer subdivisions sit in zones such as R1A* and R2A*, written into the by-law by 1990s amendments, with their own numbers. There, a one-storey house may cover 40% of the lot, and a one-storey rear addition needs a 7.5 m rear yard. Your zone is on the Town's zoning map, and we read the exact clause before drawing anything.

Does the 90% rule help my addition?

It can save you a variance. Ontario now treats a by-law's minimum setback as 90% of what it says, on urban residential land, so a 6.0 m rear yard becomes 5.4 m without asking anyone. The rule doesn't cover the Greenbelt, or the areas O. Reg. 254/23 sets aside: within 120 m of a wetland, a river or stream valley or the Great Lakes shoreline, and within 300 m of an active railway. In Whitby that excludes many ravine lots and the lakeshore. It also does nothing for lot coverage; 20% is still 20%.

What happens at Whitby's Committee of Adjustment?

Over the limit, you apply for a minor variance. The fee is $1,526, with $930 more to CLOCA if the lot is in its regulated area and $313 to Durham Region Health on a private septic system. Five appointed members hear applications at a monthly meeting on the third Thursday. The Town's page says to file three weeks ahead, but its own 2026 table sets deadlines about five weeks out: Monday 9 November for the 17 December hearing. Neighbours within 60 m get notice at least 10 days before, and you post the Town's sign on your lawn for the same 10 days. After the decision, anyone with an interest has 20 days to appeal to the Ontario Land Tribunal. With no appeal, a 17 December decision becomes final and binding once that window closes on 6 January 2027, and only then do we file for the building permit.

What the permit costs

At $22.37 per m², a 40 m² family room off the back is a permit fee of $894.80, our arithmetic. In Whitby we've added up rather than out: West Lynde went from one storey to two. The closest rear extension we've finished is Greenwood in Toronto, some 40 km west; it came with new foundation waterproofing and weeping tile.

How the job runs in Whitby

  1. Meet James

James meets you at the house, hears what you want and gives you a rough estimate on the spot. The first estimate is free.

  2. Proposal and contract

If the estimate works for you, James prepares a detailed proposal. The whole project is priced, and the contract signed with a 10% deposit, before any design work begins.

  3. Design onboarding

Our designer sends you an onboarding email with some homework: your style, how your family uses the house, and what you need and want. You share Pinterest boards, then go through them together on a Zoom call: what you like in the pictures, and what you don't.

  4. Measure and floor plans

The designer measures the house and draws the floor plan: which walls come out, where the stairs land, how new space joins the old. We go through it with you until it's confirmed.

  5. Drawings and 3D rendering

With the plan confirmed, she draws the elevations and the millwork, then puts it all into a 3D rendering, so you see the rooms before anyone orders a cabinet.

  6. Finishes presentation

We don't take you round the stores: there are too many options. Using what she learned in onboarding, the designer narrows the tile, flooring, quartz, plumbing fixtures and the rest to a few choices that suit your style, collects the samples and presents them to you in our office. If a selection changes the price, the change goes through a change order you sign.

  7. Permits and engineering

We prepare the permit drawings, bring in the structural engineer wherever a beam or a load changes, and apply to the municipality. If the plan changes after the permit is issued, we file the amendment. In Whitby, applications go through the town's online permit portal.

  8. Construction

Our crew and trades build it, with one point of contact from demolition to the last coat of paint. Our site supervisors write a job log every day, which you can follow in our online app. When we open a wall and find a problem, you hear about it, and what it costs, before we fix it.

  9. Inspections

The municipal building inspector checks the work at each stage the permit sets, before it gets covered up. Inspections are booked with Whitby's building department.

  10. Handover

We walk the finished house with you and put right anything that isn't. On one job a stair stain didn't match the new floor, so we refinished the stairs.

Questions

How much lot coverage does Whitby allow in an R2 zone?

Whitby's Zoning By-law 1784 sets maximum lot coverage at 20% in the R2 zone, the same as R1 and R3. On the smallest serviced R2 interior lot of 925 m², that is 185 m² of building footprint, our arithmetic.

Does a rear addition in Whitby pay development charges?

No. Under Ontario's Development Charges Act, enlarging an existing dwelling unit doesn't trigger development charges. A rear addition in Whitby pays the building permit fee of $22.37 per m² but none of the Town, Region or school board charges a new house pays.

What does a minor variance cost in Whitby if CLOCA regulates my lot?

In 2026, a residential minor variance in Whitby costs $1,526, paid to the Town, plus a $930 processing fee paid separately to the Central Lake Ontario Conservation Authority. CLOCA adds a $3,640 technical review fee where an application needs substantial technical review.

How long does a minor variance in Whitby take to become final?

Plan on about two months. Whitby's 2026 schedule puts the filing deadline about five weeks before each monthly hearing, and a decision becomes final and binding 20 days after the hearing if no one appeals to the Ontario Land Tribunal.

Does Ontario's 90% setback rule apply on a Whitby ravine lot?

Often not. The deemed 90% setback doesn't apply in areas O. Reg. 254/23 prescribes, which include land within 120 m of a river or stream valley, a wetland or the Lake Ontario shoreline. Lots near Whitby's ravines and the lakeshore often fall inside those distances, and there the full by-law setback still applies.
